The pressure to approve or reject the new authorities lies heavily on Republicans, as former President Donald Trump has urged the GOP to reject anything short of a “perfect” bill. With the proposed legislation, the Department of Homeland Security would gain new emergency powers to close the border should daily average migrant encounters reach certain thresholds.
Under specific conditions, such as an average of 4,000 daily crossings in one week, over 5,000 daily crossings in a given week, or crossings exceeding 8,500 in a single day, the border would be shut down. Furthermore, any migrant attempting to cross the border twice while it is closed would be banned from entering the US for one year.
President Biden has made a rare statement regarding the ongoing negotiations, describing the deal as tough and fair. The goal of the negotiators is to prevent surges that overwhelm federal authorities, and both the Biden administration and Senate leaders are deeply involved in the talks.
In December, there were over 300,000 migrant encounters, and sources suggest that if the new legislation were in effect, the border would have been closed to illegal migrants. However, certain migrants fleeing persecution would still be permitted to stay, and at least 1,400 asylum applications could be processed through legal ports of entry during an emergency.
While former President Trump has urged Republicans to reject any immigration compromise, top Senate Republicans, including Mitch McConnell, recognize the urgency to address this issue, particularly given the Democrats’ willingness to approve stricter restrictions.
